Terms of Service

These terms are an agreement between you and M4B1 For Computer Systems & Communication Equipment Software Design ("M4B1", "we", "us"), a company registered in Dubai, United Arab Emirates, covering your use of Jabee.

By creating an account or using the service you accept these terms. If you are agreeing on behalf of a company, you confirm you are allowed to bind it.

1. What the service is

Jabee connects to your WhatsApp Business account and answers messages from your customers. It answers using content you provide, and it can call systems you connect to it.

Jabee is built on the official WhatsApp Business Platform. It is an independent product and is not endorsed by, affiliated with or operated by Meta Platforms.

3. Your account

• You must give accurate details and keep them current
• You are responsible for everything done through your account
• You must keep your credentials secure and tell us promptly if they are compromised
• You must be at least 18 and able to enter a contract

4. What you are responsible for

Your customers' data

You decide what happens to your customers' data. We process it on your instructions. You are responsible for having a lawful basis for that processing, for telling your customers what you do with their information, and for handling their requests about it.

What the assistant says

The assistant answers using content you supply and generates its replies with an artificial intelligence model. It can be wrong.

You are responsible for what it says to your customers. Review its answers, keep the content you give it accurate, and do not use it where a wrong answer would cause serious harm. It is designed to pass a conversation to a person when it is not confident, but that behaviour is not a guarantee.

Meta's rules

Your use of WhatsApp is governed by Meta's own terms, including the WhatsApp Business Messaging Policy and Commerce Policy. You must follow them. Breaking them can get your number restricted or removed by Meta, which is outside our control. Meta bills you directly for conversations at its own rates.

Systems you connect

If you connect Jabee to your own systems, you are responsible for what those systems do and for the credentials you give us. Only connect systems you are entitled to connect.

5. Acceptable use

You must not use Jabee to:

• Send unsolicited bulk messages, or message people who have not opted in
• Break any law, or Meta's policies
• Impersonate another person or business, or hide that replies are automated where the law requires disclosure
• Give medical, legal or financial advice that a person should be giving
• Handle payment card details, health records, or other sensitive categories of data
• Attempt to reach systems you do not control, including through a connected tool
• Reverse engineer, resell or copy the service, except that agencies may use it for their own clients
• Place load on the service that interferes with other customers

We may suspend an account that breaches this section, and we will tell you why.

6. Payment

• Fees are shown when you sign up and are charged in advance
• Payments are handled by Stripe. We do not hold your card details.
• Meta's conversation charges are separate and billed to you by Meta. We do not add anything to them.
• You can cancel at any time, effective at the end of the paid period
• Fees already paid are not refundable, except where the law requires it
• We will give at least 30 days' notice before changing prices

7. Ownership

You own your content. The content you upload, your customers' messages and your configuration remain yours. You give us permission to use them only to provide the service to you.

We own Jabee. The software, its design and its documentation belong to M4B1.

We will not use your content or your customers' messages to train artificial intelligence models.

8. Data protection

Our handling of personal data is described in our Privacy Policy, which forms part of these terms. For your customers' data you are the controller and we are the processor.

9. Availability and support

We aim to keep the service running but do not guarantee it will be uninterrupted. We may perform maintenance, and will give notice where we reasonably can.

Support is by email during UAE business hours. There is no guaranteed response time during the beta.

10. No warranty

The service is provided as it is. To the extent the law allows, we exclude all warranties, including that the service will be uninterrupted, error free, or that the assistant's answers will be accurate or suitable for any particular purpose.

11. Limitation of liability

To the extent the law allows:

• We are not liable for indirect or consequential loss, including lost profit, lost business or lost data
• We are not liable for anything the assistant says to your customers, or for decisions made on the basis of it
• We are not liable for action Meta takes against your WhatsApp account
• Our total liability in any 12 month period is limited to the fees you paid us in that period

Nothing here excludes liability that cannot be excluded by law.

12. Indemnity

You will cover us against claims arising from your use of the service, your content, your customers' data, or your breach of these terms or of Meta's policies.

13. Ending the agreement

You may close your account at any time. We may suspend or close an account that breaches these terms, that we are legally required to close, or on 30 days' notice for any reason.

When an account closes, access stops immediately and data is deleted as described in the Privacy Policy. Ask us for an export before you close if you want one.

14. Changes to these terms

We may update these terms. For material changes we will email you at least 30 days before they take effect. Continuing to use the service after that means you accept them.

15. Governing law

These terms are governed by the laws of the United Arab Emirates. Disputes will be heard by the courts of Dubai.

16. General

• If any part of these terms is unenforceable, the rest still applies
• Not enforcing a term does not waive it
• You may not transfer this agreement without our consent. We may transfer it as part of a sale of the business.
• These terms and the Privacy Policy are the whole agreement between us
